New constitution or amendment

After the fall of the Awami League government in the students' movement, various discussions are going on about the construction of a new Bangladesh. An analysis is going on about what Bangladesh will look like in the future.

People have high expectations from the interim government. Eminent people are also talking about what reforms are needed to move the country forward in the democratic direction. Along with the state reform, the discussion of amending the constitution is now in full swing. Someone is saying - about rewriting the constitution. Some are talking about the necessary reforms. Analysts have urged the interim government to take a decision on these issues. However, the government says that no decision has yet been made on amending the constitution; Discussion is ongoing.

AF Hasan Arif, advisor to the Ministry of Local Government, Rural Development and Cooperatives, said that discussions on amending the constitution are underway. Apart from this, he said that the opinions of the students will be taken regarding the amendment of the constitution.

The local government adviser said that the next election is being discussed. Discussions are also going on whether the caretaker government system can be brought back or not. But whatever the discussion, the opinion will be taken by the coordinators. Decisions on constitutional amendment, elections and caretaker government will be made based on their opinion. He said, the demand should come from the students. What do they want, do they want something new, or reform the old constitution? It has to come from them. Coordinators will provide guidance in this regard.

Regarding constitutional amendment, senior Supreme Court lawyer ZI Khan Panna told Bangladesh Pratidin that the current constitution was written in the context of 1971. Reforms are needed for democratic reconstruction. How can a law that was meant for the exploitation of the ruling class still exist? Adivasis' rights must be guaranteed. If the administration can be bought, then how will democracy be established? Constitution needs to be amended. But if the constitution is repealed, it will be repealed again after ten-twenty years. When asked about the amendment of the constitution, in an interview given to Bangladesh Pratidin, the editor for good governance, Dr. Badiul Alam Majumdar said that radical changes should be made in the constitution to reform the state. We can change the constitution in two ways. First, we can write a new constitution by discarding the entire constitution. Secondly - How many far-reaching important changes can be made in the constitution?

Sujan editor said, how many changes need to be made in the constitution. The caretaker government in 1996 was a reflection of political compromise. Awami League has claimed that it has developed a mass movement. The BNP did not accept it at first but eventually came to power through a one-sided election and included it (caretaker government) in the constitution and resigned. It was a political compromise. But that too has been cancelled. Both parties are responsible for this. Although the Awami League passed the Fifteenth Amendment amending it completely unconstitutionally. These need to be looked into deeply and the constitution needs to be amended.

He said that it is not easy to write a new constitution without the entire constitution, it is a difficult and time-consuming matter. However, we can bring far-reaching and important changes in some aspects of this constitution. For example, what will be the government system during the election? The balance of competence of our President and Prime Minister. Many other important issues including Article 70 should be changed. You have to think about these things. He said that there are many terrible things in the constitution. One of these is Article 7(a). which was annexed by the Fifteenth Amendment. If this provision is not repealed, everyone from the chief advisor to those who we are talking about changing the constitution will be hanged. All but will be charged with treason.

Barrister Sara Hossain, a senior lawyer of the Supreme Court, said that the discrimination is still ongoing. It is quite difficult to completely scrap the constitution and rewrite it. The new constitution in new Bangladesh requires the abolition of the death penalty. Along with freedom of expression, fundamental rights need to be emphasized. The interpretation of the constitution needs to come from the Chief Justice. Amendment of the constitution requires diversity, religion requires participation of all.
